1. Acceptance of Terms

By accessing or using Kopeni One ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Kopeni One. Your continued use of the Service signifies your acceptance of any updates or modifications to these Terms.

2. Medical Disclaimer and Assumption of Risk

CRITICAL: Kopeni One is NOT a medical service and does NOT provide medical, fitness, nutritional, or health advice.

• All content, tools, calculators, and AI-generated recommendations are for informational and educational purposes only
• The Service is not a substitute for professional medical, fitness, or nutritional consultation
• You assume ALL risks associated with using information from this Service
• Consult qualified healthcare professionals before starting any peptide protocol, supplement regimen, exercise program, or diet plan
• Never disregard professional medical advice or delay seeking it because of information obtained through this Service

3. Liability Waiver and Release

By using Kopeni One, you voluntarily assume all risks and hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE Kopeni One, its owners, officers, employees, affiliates, and agents (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to:

• Any loss, damage, injury, or death that may be sustained by you
• Use of peptides, supplements, workout programs, nutrition plans, or any other protocols tracked or suggested through the Service
• Any AI-generated content, recommendations, or calculations
• Data loss, software bugs, or service interruptions
• Actions taken based on information provided by or through the Service

This release includes liability for the Released Parties' negligence and applies even if the Released Parties have been advised of the possibility of such damages.

4. Subscription Plans and Billing

4.1 Available Plans

• Free Plan: Limited features, no payment required
• Basic Plan: $9.99/month or $100/year (billed annually)
• Premium Plan: $19.99/month or $200/year (billed annually)

4.2 Free Trial

New subscribers to paid plans receive a 3-day free trial. You may cancel during the trial period without charge. If you do not cancel before the trial ends, your payment method will be charged the subscription fee.

Each user is entitled to ONE free trial per lifetime. Trial eligibility is tracked per account and cannot be reset.

4.3 Billing and Payment

• Subscriptions automatically renew at the end of each billing period
• You authorize us to charge your payment method on a recurring basis
• Monthly subscriptions renew every 30 days; annual subscriptions renew every 365 days
• Prices are subject to change with 30 days' notice
• You are responsible for providing accurate and current payment information
• If payment fails, we may suspend or terminate your access to paid features

4.4 Refund Policy

ALL SUBSCRIPTIONS ARE NON-REFUNDABLE.

• No refunds or credits will be issued for partial months or years of service
• No refunds will be given for unused features or data
• No exceptions will be made to this policy
• By subscribing, you explicitly acknowledge and accept this no-refund policy

4.5 Cancellation Policy

• You may cancel your subscription at any time through your account settings or billing portal
• Cancellation takes effect at the end of your current billing cycle
• You will retain full access to paid features until the end of the paid period
• Upon cancellation, your account will automatically downgrade to the Free plan
• No prorated refunds will be issued upon cancellation
• You may re-subscribe at any time, but will not receive another free trial

5. User Accounts and Responsibilities

• You must be at least 18 years old to use this Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate, complete, and current information
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

6. Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Share or sell your account access to others
• Attempt to reverse engineer, decompile, or extract source code
• Use automated systems or bots to access the Service
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Misrepresent your identity or affiliation
• Scrape, data mine, or extract data from the Service

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and AI models, are the exclusive property of Kopeni One and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

8. User Data and Content

• You retain ownership of data and content you submit to the Service
• You grant us a license to use, store, and process your data to provide the Service
• We may use aggregated, anonymized data for analytics and service improvement
• You are responsible for backing up your data; we are not liable for data loss
• We reserve the right to delete inactive accounts after 2 years of inactivity

9. Service Availability and Modifications

• We strive for 99% uptime but do not guarantee uninterrupted service
• We may modify, suspend, or discontinue any part of the Service at any time
• We may change features, pricing, or subscription tiers with notice
• Scheduled maintenance will be announced in advance when possible
• We are not liable for any service interruptions or data loss

10. Third-Party Services

The Service may integrate with or link to third-party services (e.g., payment processors, AI providers). We are not responsible for the content, accuracy, or practices of third-party services. Your interactions with third parties are governed by their own terms and privacy policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. We do not warrant that the Service will be error-free, secure, or uninterrupted.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOPENI ONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kopeni One and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive your right to a jury trial and to participate in class actions.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
